About this policy
Apex Ad Agency ("Apex", "we", "us") is a digital marketing agency based in Tweed Heads, NSW, serving clients across the Gold Coast, Northern NSW and Australia. We respect your privacy and handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
This policy explains what personal information we collect, why we collect it, how we use and protect it, and how you can access or correct it.
What we collect
When you submit our contact form we collect your name, email address, phone number (if provided), business name and the details of your enquiry.
When you use our AI growth plan tool we also collect your website address, industry, ideal customers, current marketing activity, goals, challenges, timeline and budget (if provided).
Like most websites, we may automatically collect limited technical information such as your browser type, device, pages visited and approximate location, to keep the site secure and understand how it is used.
We do not ask for sensitive information (such as health, financial account or government identifiers). Please don't include it in your enquiry.
Why we collect it
We use your information to respond to your enquiry, prepare proposals and consultation briefs, deliver and manage our services, send you information you have requested, improve our website and services, and meet our legal obligations.
We will only send you marketing emails if you have agreed to receive them or where permitted under the Spam Act 2003 (Cth). Every marketing email includes a way to unsubscribe.
AI growth plan
Answers you enter into the AI growth plan are processed by an artificial intelligence service to generate recommendations. Recommendations are general in nature and are not a guarantee of results. Your answers and the generated plan are saved and sent to our team so we can follow up with you.
Who we share it with
We do not sell or rent your personal information. We share it only with trusted service providers who help us run our business, such as website hosting, secure data storage, email delivery and AI processing providers, and only as needed to provide those services.
Some of these providers may store or process data outside Australia (for example in the United States or Europe). We take reasonable steps to ensure they protect your information consistently with the APPs.
We may also disclose information where required or authorised by law.
How we protect it
Enquiries are stored in a secure database with restricted access. Our forms use spam and bot protection. We keep personal information only for as long as we need it for the purposes above or as required by law, and then securely delete or de-identify it.
Cookies and analytics
Our website may use cookies and similar technologies to make the site work and to measure traffic. You can disable cookies in your browser settings, though some features may not work as intended.
Accessing or correcting your information
You can ask to access or correct the personal information we hold about you, or ask us to delete it, by contacting us using the details below. We will respond within a reasonable time, usually 30 days.
Complaints
If you have a concern about how we have handled your personal information, please contact us first and we will do our best to resolve it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
